Hi Guys,

I Was considering contract hiring a bmw so i enquired with a company on the internet, this guy asked me to email him to confirm what colour etc i wanted, so i did, he then posted me some documentation which i never completed or returned but when i shoped round i found i could get the same vehicle almost

Yup, tell him to p155 off, he's trying it on with his mate at the BMW garage, what do you want one of those sheds for anyway.

Probably not legally enforcible but depends what was said/written/documented in ANY form.

He's confirmed colour etc but has not entered into an agreement as he has not signed any order form, We could all ring/e-mail the dealer to confirm what we would like, but, as I say the guy is trying it on, take the evidence to the local Trading Standards and play him at his own game the tit.

Nothing is foolproof to a sufficiently talented fool.

no he sent me a contract via post which i never signed or returned, he emailed me the vehicle details and asked me to email response to confirm that vehicle deatils where correct and that is what he is claiming is an official order

well i have contacted the bmw garage and they are adament that i must pay this charge regardless of me not having signed any paper work or the fact that i have never even heard of them as they are based in leeds, they have demanded payment within 7 days, got an appointment with cab on monday, contacted a solicitor and was told that it could cost me more in legal fees to fight it.. i feel like im being held at gun point because if i dont pay and they take legal action it will effect my credit rating :angry2:

As norman said, contact trading standards, if you did all this over the phone or internet then it should be covered by distance selling and you can send it back anyway for a full refund.

Regardless of who said or wrote what, whatever happened to a cooling off time? just don't pay it.
